Probate is the process of administering the estate of a deceased person. Drastically simplified, this is the process of collecting all of their assets and paying their debts. Whether or not a deceased person had a will determines the set of rules that we play by. There are three types of probate available in Colorado and our Office can help decide which type is best for a given situation. Guardianship is the process of naming a Guardian for a protected individual (child or adult). In Colorado a Guardian may be appointed for an adult if the court finds such adult to be incapacitated and that their needs cannot be met by less restrictive means. A Guardian is tasked with taking care of the person, including their support, care, health, education and welfare of the ward.
Similarly, Conservatorship is the process of naming a Conservator for a protected individual. In Colorado, a Conservator may be appointed for an adult individual if the court finds they are unable to manage their property and business affairs because the individual is not able to effectively receive and evaluate information and the individual has property that is necessary for their support, care, health, education and welfare that would otherwise be wasted or dissipated.
